SUMMARY:Coercive Control as Abuse
DESCRIPTION:The Honorable Marianne C. Hinkle (ret.)\, former Chair\, Trial Court Domestic and Sexual Violence Education Task Force Bethany Stevens\, Esq.\, Chief Legal Officer/Director of Legal Policy & Judicial Training\, Administrative Office of the District Court Benjamin B. Selman\, Esq.\, Legal Training Attorney\, Committee for Public Counsel Services Jamie Ann Sabino\, Esq.\, Deputy Director of Advocacy\, Massachusetts Law Reform Institute. \nIn 2024\, the Massachusetts Legislature passed a new law that has expanded the definition of abuse in the context of G.L. c. 209A to include “coercive control\,” which is statutorily defined and includes a comprehensive list of what could be considered nonviolent conduct. In addition to expanding the bases upon which an abuse prevention order may be issued\, this new definition impacts a number of statutes which cross-reference G.L. c. 209A’s definition of “abuse.” \nThis program will cover the legislative history leading to this amendment and a detailed review of the statutory revision in c. 209A proceedings\, as well as how this revision might influence the interpretation of abuse in related statutes such as bail and firearms laws. Discussion will include how coercive and controlling behaviors are addressed in the Guidelines for Judicial Practice: Abuse Prevention Proceedings. Discussion will include the available remedies that may be ordered. \nThe following topics will be covered: \n\nStep by step review of the language of the amendment\nHarms proponents of the bill seek to address\nRevision of court forms and resource material\nComparison with similar laws in other jurisdictions\nImpact beyond G.L. c.209A\n\nOther statutes in which abuse is referenced (e.g. bail)\nReference to coercive and controlling behaviors in the Guidelines for Judicial Practice: Abuse Prevention.\n\n\nImpact on criminal defense and related 209A practice

For now\, sessions will be virtual. Applicants should block the following dates:\n\n\nDec 18 (9- 12:30)\nJan 9 (9-12)\nJan 30 (9-12)\nFeb 18 (9-12)\nMar 5 (9-12)\nMar 21 (9-12)\nApr 7 (9-12)\n\nThere will be self-study between workshops with relevant readings\, videos etc. \nWhat is Expected \nApplicants to the MLP I program are making a psychological “contract” to themselves\, their peers\, and senior management. Learning is hard work and requires full commitment. People have different learning styles and needs; this program asks you to coach and work with peers\, experiment with new behaviors on the job\, and be open to learning more about yourself. We understand that this is a meaningful commitment to make\, and we are confident that you will learn and grow significantly by participating in MLP I. At the same time\, if you are interested in applying\, but feel that circumstances are not right for you now\, we encourage you to keep the program in mind and apply when the next program is announced. \nParticipant Selections \nSince the program is limited\, we expect that we will have more applications than spots available. Selections will be made to create a diverse group across positions\, divisions\, and units.
