 This interactive training aims to provide you with the law and mechanics of representing a witness under Article 12 of the Massachusetts Declaration of Rights and the 5th Amendment of the US Constitution. In addition to an overview of basic legal principles of witness representations, presenters will guide you through practical application of how to use the privilege to protect your client and stand up to government encroachment on their right against self incrimination.

Topics will include:

How to advise a client re the validity of the Fifth Amendment

What to do when the client has already spoken with the police

What are the obligations of the government relative to witnesses before a grand jury

The mechanics of a Luman Martin Hearing

What constitutes a waiver of the privilege (C v. Borans)

What would constitute contempt and what are the penalties

How to effectively litigate on behalf of your client
