—Improve understanding the process of filing a notice of appeal after a hearing or trial;
—Learn how to preserve the right of appeal more effectively.

Presenters: Karen Talley, Director of Mental Health Appeals, and Devorah Vester (fka Borenstein), Mental Health Appeals Staff Attorney

Attorney Talley’s presentation will highlight recent decisions as well as older precedent in mental health law. She will address issues such as less restrictive alternatives and substituted judgment, drawing on cases that include In the Matter of a Minor, 484 Mass. 295 (2020), and Superintendent v. Saikewicz, 373 Mass. 728 (1977).

Attorney Vester will focus on 9(a) appeals from completing the Notice of Appeal to helpful hints for preserving the record for appeal.
