PRACTICAL APPLICATION OF CASELAW TO COMMITMENT HEARINGS

PRESENTER: DEVORAH VESTER, MENTAL HEALTH APPEALS STAFF ATTORNEY

Attorney Vester will give a presentation focusing on how to best utilize older and newer mental health case law during two phases of the commitment case. She will discuss the use of cases to (1)  assist with relevant hearsay objections during the hospital’s case, and (2) lay down the legal standard for the motion for required finding. The goal is to give counsel a reliable structure for the practical application of caselaw at the hearing. Attendees will learn that the purpose of the structure is to not only give the court an opportunity to reflect on the law and avoid erroneous rulings/findings, but also to support trial counsel in preserving the record for appeal.
